By accessing or using Lurkrr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Lurkrr is a web-based tool that allows users to view publicly available Instagram content — including profiles, posts, stories, reels, and highlights — without requiring an Instagram account or login. The Service does not access private accounts or data protected by privacy settings.

3. Public Data Access

The Service exclusively accesses publicly available information consistent with the legal precedent established in hiQ Labs, Inc. v. LinkedIn Corp. (2022). We do not circumvent access controls, authentication mechanisms, or privacy settings. Only content that is publicly visible to any internet user without authentication is accessible through our Service.

4. User Responsibilities

• You agree not to use the Service for harassment, stalking, or any illegal purpose.
• You agree not to use automated tools or scripts to excessively access the Service.
• You agree not to redistribute downloaded content for commercial purposes without the content creator's consent.
• You are solely responsible for how you use content accessed through our Service.

5. Pro Subscription

Lurkrr Pro is an optional paid subscription that provides enhanced features including ad-free browsing, higher rate limits, and batch download capabilities. Subscriptions are billed monthly ($4.99/mo) or annually ($39.99/yr) through Stripe. You may cancel at any time; access continues until the end of the current billing period. No refunds are provided for partial billing periods.

6. Intellectual Property

All content accessed through the Service remains the intellectual property of its respective creators and rights holders. Lurkrr does not claim ownership of any user-generated content displayed through the Service. The Lurkrr name, logo, and website design are the property of Lurkrr.

7. Content Removal (Delisting)

Instagram account holders may request removal of their profile from our Service at any time by submitting a delisting request through our Remove Profile page. Verified removal requests are processed within 24-48 hours.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. Lurkrr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. We do not guarantee continuous, uninterrupted, or error-free operation of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration.
